$12.5M Lawsuit over Falling Streetlights

 

New Mexico’s largest city is suing seven parties including the manufacturer, specifiers and contractors involved in a large street light project.

The City of Albuquerque claims that multiple streetlights manufactured by California-based Environmental Lighting for Architecture (ELA) are falling to the ground after installation. 

According to the lawsuit, dozens of the 25lb. lights fell on the street from heights of up to 25 feet.

The lawsuit alleges breach of contract, negligence and strict liability. The city is seeking $2.5M in damages and an additional $10M in punitive damages..

The list of defendants are:

  • Environmental Lighting for Architecture (ELA)
  • HDR Engineering
  • Dekker/Perich/Sabatini Architecture
  • Bradbury Stam Construction
  • Bixby Electric
  • Dalkia Energy Solutions
  • MWI Inc.

According to a report by KRQE, ELA claims that the city modified the light fixtures against their recommendations which, in turn, voided the warranty. The city is reportedly going to retrofit or replace over 1000 street lights.
