RAB Lighting Faces New Patent Lawsuit

RAB Lighting is one of five companies targeted (so far) in a IP lawsuit campaign

 

In a legal action filed this week, Texas-based BX LED LLC has lodged a lawsuit against RAB Lighting, Inc., alleging patent infringement related to a suite of eight patents covering various lighting technologies. The case was filed in the U.S. District Court for the Northern District of Texas.

This action against RAB is one of numerous lawsuits in a patent infringement campaign as BX LED has filed similar suits against a number of retailers that sell LED lighting products. The lawsuit against Lowe’s was also filed this week and cites the store brand Utilitech products as infringing products.

Here is the list of 2022-2023 lawsuits filed by BX LED thus far:

  • BX LED LLC v. The Home Depot U.S.A. Inc.

  • BX LED LLC v. Walmart Inc.

  • BX LED LLC v. Wayfair LLC

  • BX LED LLC v. Lowes Companies, Inc. et al

  • BX LED LLC v. RAB Lighting Inc

 

BX LED alleges that RAB Lighting has been selling their proprietary technologies without authorization. The list of alleged infringements includes several commercial lighting products such as RAB A17-3T70N, RAB ALED 5T52, RAB H17 Bay Light, among others. These products, BX LED asserts, are marketed and distributed throughout the United States, including Texas.

The patents in question, owned by BX LED, cover a variety of aspects of LED light technology:

  • Patent No. 6,869,812 deals with a high-power AllnGaN based multichip light emitting diode.

  • Patent No. 7,901,109 describes a heat sink apparatus for solid state lights.

  • Patent No. 7,973,465 pertains to a light emitting diode with a thin multilayer phosphor film.

  • Patent No. 8,203,260 relates to a color temperature tunable white light source.

  • Patent No. 8,567,988 pertains to an efficient LED array.

  • Patent No. 8,143,769 covers a light-emitting diode (LED) lighting device.

  • Patent No. 9,913,333, and U.S. Patent No. 10,966,300, both titled “Light sources utilizing segmented LEDs to compensate for manufacturing variations in the light output of individual segmented LEDs,” were issued on March 6, 2018, and March 30, 2021, respectively.

 

BX LED is seeking compensation for the damages they claim to have suffered and will continue to suffer due to RAB Lighting's alleged infringement of these patents.

In addition to monetary damages, BX LED is seeking an enhancement of damages because of what it claims is willful infringement by RAB Lighting. BX LED is also seeking attorneys' fees, costs and expenses of the action, and pre and post-judgment interest. The Texas company has demanded a trial by jury on all issues that can be tried.

Court documents indicate that RAB Lighting has not yet been served with the summons. Once the summons is served, RAB Lighting will have 21 to 60 days to file its response.
