Two More Lighting Lawsuits

Two new lighting-related filings:  Product Liability and Breach of Contract 

 

LED International Lighting, Inc.
   vs.
Arrow Electronics,
Thomas Research Products &
Hubbell Inc.

This is a new case filing in a new court of jurisdiction for a lawsuit that was originally filed in 2018.  On September 9, the case was transferred from the Circuit Court of the Fifth Judicial Circuit in Hernando County, Florida to the Tampa Division of the United States District Court for the Middle District of Florida, on the basis of diversity jurisdiction.

The Plaintiff alleges that in 2013 Arrow Electronics and Thomas Research Products (a subsidiary of Hubbell Inc.) sold products to LED International Lighting without disclosing the following:

  • The drivers had been previously identified as being defective
  • The drivers lacked integrated surge protection
  • The drivers were not UL Certified

 

The Plaintiff accuses Arrow Electronics of breach of contract, negligent misrepresentation and breaches of implied & express warranties.  Hubbell is accused of breach express warranties.


GoEco LED 
   vs.
Specialty Lighting Group

GoEco is an LED dealer and manufacturer’s representative that represented Korean fixture manufacturer, Lumens Co. Ltd.  Specialty Lighting Group is a Connecticut-based lighting distributor that is best known for providing project management and other services related to mulit-location, national account lighting projects.

GoEco claims that it brought national account business to Specialty Lighting Group.  GoEco was to provide Lumens panel lights for new-store openings of Subway Sandwich stores, to be followed eventually by retrofits of existing Subway Sandwich Stores, as well as sales expansion into other national chains to which Specialty Lighting supplied.  GoEco claims that Specialty Lighting executed a 5-year purchase and distribution agreement for panel lights manufactured by Lumens.  The lighting orders would total 3000 units per month.

GoEco alleges that Lumens unilaterally, and without prior notice, effectively terminated future supply of panel light shipments.  Allegedly as a result of the suspension of supply caused by the events, Specialty Lighting indicated to GoEco that Specialty Lighting would be damaged by Lumens’ refusal to ship, and that Specialty Lighting would withhold payments due of $732,400 until it could fully assess the extent of its alleged damages. GoEco is suing Specialty Lighting for the $732,400, plus interest and other damages.

GoEco filed similar a similar suit vs. Specialty Lighting in April 2018.  The case was dismissed without prejudice five months later.
